April 24, 2024, the U.S. International Trade Commission (ITC) announced that it has issued a final determination in the Section 337 investigation concerning certain active matrix organic light-emitting diode display panels and modules for mobile devices, and components thereof (Certain Active Matrix Organic Light-Emitting Diode Display Panels and Modules for Mobile Devices, and Components Thereof, Investigation No.: 337-TA-1351). The Commission reviewed an initial determination (No.44) issued by the presiding administrative law judge on January 9, 2024, vacated that initial determination, and remanded the matter for further proceedings. The original initial determination had terminated the investigation based on the complainant’s lack of constitutional standing.
On March 22, 2023, the U.S. International Trade Commission (ITC)issued a final determination declining to review an initial determination (No.7) issued by the presiding administrative law judge on March 15, 2023, thereby granting the motion filed by Mianyang BOE Optoelectronics Technology Co., Ltd. to intervene as a respondent in this investigation.
On January 27, 2023, the U.S. International Trade Commission (ITC) voted to institute a Section 337 investigation concerning certain active matrix organic light-emitting diode display panels and modules for mobile devices, and components thereof (Certain Active Matrix Organic Light-Emitting Diode Display Panels and Modules for Mobile Devices, and Components Thereof) (Investigation No.: 337-TA-1351).
On December 28, 2022, Samsung Display Co., Ltd. of the Republic of Korea filed a complaint with the U.S. ITC requesting institution of a Section 337 investigation, alleging that the importation into and sale within the United States of certain active matrix organic light-emitting diode display panels and modules for mobile devices, and components thereof, infringe its intellectual property rights (U.S. Patent Nos. 9,818,803, 10,854,683, and 7,414,599). Samsung requested that the U.S. ITC issue a general exclusion order, a limited exclusion order, and cease and desist orders.
